Terms of Service

Please read these terms carefully before using our services

1. Agreement to Terms

By accessing and using the NextCanvas website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. NextCanvas is run by Next Canvas, Inc., a 501(c)(3) nonprofit organization, and is provided free of charge.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on NextCanvas's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials
  • Use the materials for any commercial purpose or for any public display
  • Attempt to decompile or reverse engineer any software contained on the website
  • Remove any copyright or other proprietary notations from the materials
  • Transfer the materials to another person or “mirror” the materials on any other server

The materials on this site now include artwork, writing and photographs that belong to the members who made them, not to NextCanvas. The restrictions above apply to that work too, and the community guidelines put it in plainer words: do not download, repost, screenshot, distribute, or use another member's artwork, writing, or personal content outside the community without their permission.

3. Artwork Submission

By submitting artwork to NextCanvas, you represent and warrant that:

  • The artwork is your original creation and you own all rights to it
  • You have obtained all necessary permissions and consents for submission
  • The artwork does not infringe upon any intellectual property rights of third parties
  • The artwork was made without generative AI, which may not be submitted in spaces meant for original student artwork
  • You grant NextCanvas the right to display and exhibit your artwork on this site

Every artwork submission asks you to confirm this before it can be published, and student submissions are held for a mentor to review before they appear.

You keep the copyright in everything you submit. The right you grant NextCanvas is non-exclusive and covers showing your work on this site, and nothing more. It is not a transfer of ownership, we do not sell your work, we do not use it in advertising, and when you delete a post the right to display it ends with it. If we ever want to use a piece outside this site, we will ask you first.

Photographs submitted from a NextCanvas gathering show other people, so the same warranties apply to them: submit a photograph only where everyone identifiable in it has agreed to appear on this site, and where anyone under 18 has a parent or guardian's agreement. The submission form asks you to confirm this, and a moderator reviews every event submission before any of it is published.

If you appear in a photograph on this site, or you are the parent or guardian of someone who does, you can ask us to take it down by writing to info@nextcanvas.org. You do not need an account to ask, you do not have to give a reason, and we will remove it.

4. Parental Consent for Minors

You must be 13 or older to create an account. Students under 18 years of age must obtain parental or guardian consent before submitting artwork or participating in NextCanvas programs. Parents and guardians are responsible for reviewing these Terms of Service and our Privacy Policy. By providing consent, parents and guardians agree to these terms on behalf of their child. The site does not currently ask for that consent when an account is created and does not collect a parent or guardian's contact details, so obtaining it rests with the student and their family. A parent or guardian may write to the address below to review, request the deletion of, or refuse further collection of their child's information.

5. High School Ambassadors

The High School Ambassador programme is open to high-school students with an account here. There is one ambassador per high school, and a place can be handed on to another student. If your application is approved, you agree that NextCanvas may show your display name and your school's city or region on this site to identify you as an ambassador. Your school's name is not published.

That permission is narrow and you can take it back. It does not extend to fundraising, advertising, or sponsor materials, and we will not use your name or your school in any of them. An ambassador represents NextCanvas and not their school; NextCanvas is not affiliated with, or endorsed by, any school. You may withdraw at any time from the ambassador page or by writing to the address below, and withdrawing takes you off the Community Events page. NextCanvas may also end an ambassador term, including when a student has finished school.

6. Accounts and Community Conduct

An account belongs to one person, and the display name and profile on it are shown publicly. NextCanvas is intended for high school students and other participants specifically invited or approved by the NextCanvas team, and we may limit or remove access if an account does not fit the intended purpose of the community.

By joining this community you agree to follow the community guidelines. The NextCanvas team may review, remove, limit, or decline any content, account, or submission that does not align with the purpose, safety, or values of the community. Serious or repeated violations may result in suspension or removal from the community. In practice a moderator can hide or remove a post and can block an account. You may delete your own account at any time from the Settings page, without asking us first.

7. Disclaimer of Warranties

The materials on NextCanvas's website are provided on an ‘as is’ basis. NextCanvas makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. The same applies to the service itself, and we may change or discontinue features as the community evolves.

8. Limitations of Liability

In no event shall NextCanvas or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on NextCanvas's website, even if NextCanvas or an authorized representative has been notified orally or in writing of the possibility of such damage.

9. Accuracy of Materials

The materials appearing on NextCanvas's website could include technical, typographical, or photographic errors. NextCanvas does not warrant that any of the materials on its website are accurate, complete, or current. NextCanvas may make changes to the materials contained on its website at any time without notice. Much of what appears on the site is written by members rather than by NextCanvas, including the opportunities they post, so check the details of an opportunity with the organization running it before you rely on them.

10. Links

NextCanvas has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by NextCanvas of the site. Use of any such linked website is at the user's own risk. That covers the links members post with an opportunity, and it covers video: where a member has pasted a YouTube or Vimeo link into the forum, the player is loaded from that service, and that service's own terms and privacy practices apply to the view.

11. Modifications

NextCanvas may revise these terms of service for its website at any time without notice. By using this website, you are agreeing to be bound by the then current version of these terms of service.

12. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of New York. Any disputes arising under these terms shall be resolved in the state or federal courts located in New York.
